The Supreme Court is doing something out of character: Obeying precedents: “A landmark statute protecting Indian tribes from cultural genocide is upheld.” In its 7-2 decision in Brackeen, the Supreme Court rejected an array of constitutional challenges a group of non-Indian families made to this law. These families, who wanted to adopt American Indian children, alleged that the ICWA violates the Constitution in at least four different ways. [This piece will use the term ‘Indian’ to refer to tribal citizens, and not ‘Native American’ because the word ‘Indian’ has a very precise legal meaning in federal law that is distinct from the meaning of the term ‘Native.’]

Then the state came for her second child. More than 700 Native American children, or about one of every 40 living in the state, experienced the termination of their parents’ rights from 2017 to 2021, the ProPublica analysis found. That was one of the highest rates in the country and nearly 13 times the rate for white children in the state.

Arizona Is Extracting Steep Concessions to Thwart Navajo Nation’s Water Rights: When handed tribes’ water claims, Arizona has responded by creating cumbersome hurdles that don’t exist in other states. On March 20, the Navajo Nation argued that the United States government breached its legal responsibility to ensure access to water on the Navajo reservation. Trading water access for accepting lower priority, requiring tribes to forfeit the ability to expand their reservations, attempting to make casino licenses contingent on water deals, these are just some of the ways Arizona has tried to coerce tribal nations into settlements just to get access to water that was theirs to being with. Navajos use 8-10 gallons of water per day, about a tenth of the average American, and 30 percent of Navajos have no running water.
